Condition or Practice: The nuetral safety switch on the #389 Ford F-350 service truck did not function properly when tested. This condition exposes the miner to the hazard of being able to start the truck while the transmission is in gear and the clutch not depressed.
11-2-09 - 7000-3a - 1. Subsequent Action - Upon further review and research it has been determined that this piece of equipment is available to other miners. This changes the likelihood from unlikely to reasonably likely. And the S&S from no to yes.

Action to Terminate: The switch was replaced and functioned properly when tested.

Why this concerns you: The inspector hand delivered the 7000-3a form on 11-30-09 claiming it wouldn't go through the mail. The inspector states "upon further review and research". This was not done at the mine site. Reseach at the mine site would have discovered that this truck is used by 1 employee and the doors are lock when the employee is not at work. The contested verdict came in on 4-5-10 and the citation was changed back to non S&S and unlikley.
